1. Acceptance of Terms
By accessing or using LinkFeather ("Service"), operated by LinkFeather Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Description of Service
LinkFeather is an electronic signature platform that allows users to upload, send, sign, and manage documents electronically. The Service includes web-based applications, APIs, and related services.
3. Account Registration
To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account.
4. Electronic Signatures
LinkFeather facilitates electronic signatures in compliance with the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA). By using the Service to sign documents, you consent to conducting transactions electronically and agree that your electronic signature carries the same legal weight as a handwritten signature.
5. Acceptable Use
You agree not to use the Service for any unlawful purpose, upload documents containing malware or malicious code, attempt to gain unauthorized access to the Service or its systems, interfere with or disrupt the Service, impersonate another person or entity, or use the Service to send unsolicited communications or forge signatures.
6. Subscription and Payments
Some features require a paid subscription. Fees are billed in advance on a monthly basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
7. Your Content
You retain ownership of all documents and data you upload to LinkFeather ("Your Content"). You grant us a limited license to store, process, and transmit Your Content solely to provide the Service. We do not access, review, or share Your Content except as necessary to operate the Service or as required by law.
8. Data Retention
Completed documents and audit trails are retained for the duration of your account. Upon account deletion, your data will be permanently removed within 30 days, except where retention is required by law.
9. API Usage
Access to our API is subject to rate limits and usage quotas as defined by your subscription plan. API keys are confidential and must not be shared publicly. We reserve the right to suspend API access for abuse or excessive usage.
10. Intellectual Property
The Service, including its design, code, and branding, is owned by LinkFeather Inc. and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
11. Limitation of Liability
To the maximum extent permitted by law, LinkFeather shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time through your account settings.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
